• Promote or facilitate prostitution or escort services
• Post, upload, or share content that involves individuals under the age of 18
• Post, upload, or share content that involves non-consensual acts, violence, or cruelty
• Use the services in any manner that could disable, overburden, damage, or impair the site

3.2 Content Guidelines. As TopChat.cam aggregates content from other cam platforms, you agree to adhere to the content guidelines of those platforms when accessing their content through our service. We do not control the content on third-party platforms and are not responsible for any content that may violate these Terms.

4. Intellectual Property

4.1 Ownership. The website and its original content, features, and functionality are owned by TopChat.cam and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4.2 Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the services for your personal, non-commercial use.

Any interaction between you and a cam model is subject to the terms and policies of the platform hosting that model.

SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO: (1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, SECURITY, USEFULNESS, INTEROPERABILITY, OR CONTENT OF THE SERVICES; AND (2) ANY WARRANTIES OF TITLE, WARRANTY OF NON-INFRINGEMENT, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of Liability

8.1 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOPCHAT.CAM, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (1) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (2) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (3) ANY CONTENT OBTAINED FROM THE SERVICES; AND (4) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

8.2 Cap on Liability. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST SIX (6) MONTHS, OR $100.00, WHICHEVER IS GREATER.

9. Indemnification

You agree to defend, indemnify, and hold harmless TopChat.cam, its parent company, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (1) your use of and access to the services; (2) your violation of any term of these Terms; (3) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (4) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the services.

10. Termination

10.1 Termination by You. You may terminate your account at any time by following the instructions on the website or by contacting us.

10.2 Termination by Us. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will immediately cease.

10.3 Effect of Termination. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution

11.1 Governing Law. These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

11.2 Dispute Resolution. Any dispute arising out of or relating to these Terms or our services shall be resolved by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in California, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

11.3 Class Action Waiver. ANY ARBITRATION UNDER THESE TERMS WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED.

11.4 Small Claims Court. Notwithstanding the foregoing, you may bring an individual action in the small claims court of your state or municipality if the action is within that court's jurisdiction and is pending only in that court.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the services.

13. Miscellaneous

13.1 Entire Agreement. These Terms, together with the Privacy Policy and any other legal notices published by TopChat.cam on the services, shall constitute the entire agreement between you and TopChat.cam concerning the services.

13.2 Severability. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

13.3 Waiver. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.

13.5 Notice. Any notice or other communication to be given hereunder will be in writing and given by email to admin@pornspotlight.link.

14. 2257 Compliance Statement

TopChat.cam is not a producer (primary or secondary) of any content found on this website. For 18 U.S.C. 2257 compliance, please contact the appropriate content provider platform directly. As an aggregator of content from other platforms, we require all our partner platforms to be in full compliance with 18 U.S.C. 2257 and maintain their own records as required by law.
